香港租約重點須知

在香港簽訂租約前，有幾個關鍵重點必須注意。首先，確保租約清楚列明雙方（業主及租客）的全名及身份證號碼。這對於日後任何法律程序都至關重要。

Before signing a tenancy agreement in Hong Kong, there are several key points you must pay attention to. First, ensure the agreement clearly states the full names and HKID numbers of both parties (landlord and tenant).

租約必須清楚列明物業地址、租期、租金金額、按金金額、交租日期及支付方式。此外，管理費、差餉及水電煤等雜費由誰支付也應明確記載。

The agreement must clearly state the property address, lease term, rent amount, deposit amount, rent payment date, and payment method. Additionally, who pays management fees, government rates, and utilities should be clearly specified.

另一個重要項目是死約期（Fixed Period）和生約期（Optional Period）。一般香港租約為「一年死約、一年生約」，即首12個月內雙方不能提前解約；第13至24個月期間，任何一方可給予通知期（通常為1-2個月）後解約。

在簽約前，建議檢查物業的狀況，拍照記錄，並在租約中列明傢俬電器的清單。如有特別條款（如不可養寵物、不可吸煙等），也應清楚寫入租約。

最後，簽署租約後，應在30天內向稅務局繳交釐印費（印花稅），否則可能在法庭上不被接納為證據。釐印費通常由業主和租客分擔。
